Public offer for access to the Base VPN service

This is an English translation. If it differs from the Russian version, the Russian version prevails.

Individual entrepreneur Dello Denis Sergeevich (INN 770980945851, OGRNIP 326774600254874), the "Provider", offers any person with full legal capacity, the "User", to conclude a service agreement on the terms of this public offer (Articles 435 and 437(2) of the Civil Code of the Russian Federation).

1. Definitions

1.1. Service — the Base VPN service: the Telegram bot @basevpnapp, the website basevpn.app, the VPN servers and the subscription link.

1.2. Subscription — paid access to the Service for 30, 90, 180 or 360 days.

1.3. Plan — the terms of a Subscription: period, price, number of devices, traffic on whitelist servers. Current plans are shown in the bot before payment.

1.4. Traffic package — extra whitelist-server traffic bought for an active Subscription.

1.5. Trial — access for the period and with the limits shown in the bot: free (3 days) or paid (7 days for 1 ₽ with a linked bank card and auto-renewal). Each kind of Trial is granted once per Telegram account.

1.6. Key — the personal subscription link used by the User's app to connect.

1.7. Auto-renewal — an automatic charge to the User's bank card for the next Subscription period, made with the User's separate consent (recurring payment), see section 5.

2. Subject

2.1. The Provider gives the User access to its VPN servers under a Subscription, and the User pays for it according to the Plan.

2.2. The service is provided electronically. Access opens automatically right after payment: the Key and setup instructions appear in the bot. Nothing is delivered physically.

2.3. A third-party app (for example, Happ) is used to connect. The Provider is not its developer.

2.4. The Provider does not sell access to third-party websites or services and is not responsible for their content or availability.

3. Acceptance

3.1. Paying for a Subscription, a Traffic package or a bot balance top-up accepts this offer. Activating the free Trial accepts it for the Trial. Paying for the paid Trial with the auto-charge consent ticked accepts this offer, including section 5 and the Auto-renewal terms.

3.2. The agreement is concluded upon acceptance.

3.3. The User confirms having read and agreed to this offer and the Privacy policy.

4. Prices and payment

4.1. Prices, periods and limits are shown in the bot before payment. The price is fixed at payment and does not change during the paid period. As of this version a Subscription on the Base plan costs: 30 days — 382 ₽, 90 days — 1062 ₽, 180 days — 1997 ₽, 360 days — 3399 ₽.

4.2. Payment is made by bank card, T-Pay or Mir Pay through the CloudPayments payment service (CloudPayments LLC) or with Telegram Stars. Card details are entered on the CloudPayments page; the Provider never receives or stores the card number or CVC.

4.3. Subscriptions are sold for 30, 90, 180 or 360 days, counted from payment. A renewal is added to the current period.

4.4. Auto-renewal is turned on only when the paid Trial is paid by bank card and only after a separate consent on the payment screen in the bot (section 5). Other payments, including Telegram Stars, never turn on auto-renewal.

4.5. Traffic packages are bought for an active paid Subscription. Unused package traffic is kept on renewal.

4.6. The paid Trial is available if the User has no active Subscription or Trial and has never paid for a Subscription or the paid Trial. The free Trial is available if the User has never had a Subscription or a Trial.

4.7. The bot balance can only be used to pay for the Service.

4.8. A cash receipt (Federal Law 54-FZ, CloudKassir) is issued for every CloudPayments payment, auto-charge and refund and sent to the e-mail entered on the payment page; a copy is available from support. No VAT is charged: the Provider applies the automated simplified tax system (AUSN).

5. Auto-renewal (recurring payments)

5.1. Auto-renewal is turned on when the paid Trial (7 days for 1 ₽) is paid by bank card in the bot, and only after a separate consent tick on the payment screen:

I agree to automatic charges: after the trial — 382 ₽ every 30 days. Turn off any time in Profile.

Without the tick the payment button does not appear. If CloudPayments did not save the card, auto-renewal is not turned on and the Trial still applies. Turning auto-renewal on and off is free. The User confirms the right to use the card they pay with.

5.2. After the Trial the card is charged the price of 30 days on the Base plan stated in the consent (382 ₽ as of this version), then the same amount every 30 days. No other amounts are charged. Money on the bot balance is used first; the rest is charged to the card.

5.3. The charge is made within the last 24 hours of the paid period. The 30 paid days are added to the end of the current period, so no time is lost.

5.4. At least 3 days before the charge (72 hours before the last 24 hours of the period begin) the bot sends a Telegram message with the amount, the charge date, the last 4 digits of the card and how to turn auto-renewal off. After the charge it sends the amount and the new end date.

5.5. If a charge fails, the bot says so and the Provider retries the same amount no more than three times: 1, 4 and 9 days after the first attempt. The Subscription is extended by 30 days from the successful payment. If the User pays for the Subscription themselves, there are no more retries. After the last failed attempt auto-renewal stops and the bot says so.

5.6. The User may turn off auto-renewal and withdraw the card at any time: in the bot under Profile → "Turn off auto-renewal", by writing to @qalqan_support or to admin@qalqan.app. From that moment no new charges are made, the card is unlinked and the paid period stays.

5.7. A new auto-renewal price applies only after the User's new separate consent.

5.8. An auto-charge is refunded in full if the User asks within 48 hours of the charge. Later requests follow section 8. After a refund auto-renewal is turned off.

5.9. Card details are entered on the CloudPayments page and processed by CloudPayments LLC under PCI DSS. The Provider never receives or stores the card number or CVC. For auto-renewal the Provider keeps only the technical card token issued by CloudPayments and the masked card number.

5.10. When banks or payment systems review the User's transactions, the Provider may give them information on the consent, notices, charges and access provided.

6. Rights and obligations

6.1. The Provider shall open access right after payment, keep the servers running and fix failures within a reasonable time, answer support requests and process personal data under the Privacy policy.

6.2. The Provider may carry out maintenance (announcing it in advance where possible), change the server set without worsening the paid Plan, and suspend access for a breach of section 7.

6.3. The User shall pay on time, not share the Key beyond the Plan's device limit and comply with section 7.

6.4. The User may use the Service within the Plan, contact support and cancel at any time with a refund under section 8.

7. Acceptable use

7.1. The Service must not be used for unlawful activity, including malware, spam, phishing, attacks on networks and services, infringement of third-party rights including copyright, distribution of information prohibited by law, or fraud.

7.2. Reselling access, creating load that disturbs other users and bypassing the Plan's technical limits are prohibited.

7.3. For a breach of section 7 the Provider may suspend or terminate access. If the breach is not confirmed, the Subscription is extended by the suspension time.

8. Refunds

8.1. The User may cancel a Subscription at any time and get a refund on first request.

8.2. The refund is the cost of the unused period: Subscription price × full unused days ÷ Subscription days.

8.3. For a Traffic package, the unused volume is refunded pro rata. The bot balance is refunded in full.

8.4. To request a refund, write to @qalqan_support or admin@qalqan.app with your Telegram ID (shown in the bot under «Profile»).

8.5. The refund is made with the original payment method: to the same card or account, and in Telegram Stars for Stars payments, within 10 days of the request. The time it takes to reach a card depends on the bank.

8.6. Access under a refunded Subscription ends.

8.7. The free Trial and bonus credits (including referral bonuses) are not refundable. Auto-charges are also covered by clause 5.8.

9. Liability

9.1. The parties are liable under the law of the Russian Federation.

9.2. The Provider is not liable for outages caused by third parties (internet providers, authorities, website owners, app stores, Telegram) or by force majeure.

9.3. If access was unavailable through the Provider's fault for more than 24 hours in a row, the Subscription is extended by the downtime, or the User may get a refund under section 8.

9.4. The Provider's liability is limited to the amount paid for the current Subscription period, unless the law provides otherwise.

9.5. The User is responsible for their own actions on the internet while using the Service.

10. Personal data

10.1. Personal data is processed under Federal Law No. 152-FZ "On Personal Data" and the Privacy policy.

10.2. The Provider does not record traffic content or browsing history.

11. Term and changes

11.1. The agreement is valid until the end of the paid Subscription period (with auto-renewal, including renewals) or until the User cancels.

11.2. The Provider may change this offer by publishing a new version at basevpn.app/offer. A paid period keeps the terms in force on the payment date if they are better for the User.

11.3. Claims are sent to admin@qalqan.app and answered within 10 days. Unresolved disputes go to court under the law of the Russian Federation, respecting consumer rights.
